VERDICT:  Plaintiff for $45,000.00

CLAIMED MEDICAL EXPENSES:  $27,702.44

CLAIMED LOST INCOME:  $5,700.00

INSURANCE CARRIERS: Progressive Max with $25,000.00 for Defendant.  GEICO General Insurance Company as Plaintiff’s underinsured motorist carrier with coverage of $75,000.00, meaning exposure of $50,000.00.

LAST PRE TRIAL OFFER/DEMAND:  Progressive Max paid its policy limits to Plaintiff in advance of trial.  GEICO actually had two policies of underinsured motorist coverage, one for $25,000.00, and one for $50,000.00.  GEICO tendered the limits of the $25,000.00 policy before trial, meaning Plaintiff recovered this amount notwithstanding the verdict.  Plaintiff had made a further demand of $10,000.00 from GEICO to which they had offered $5,000.00.

OTHER INFORMATION:  This motor vehicle collision occurred on December 18, 2006, on Eisenhower Parkway at Knoxville Road when Defendant failed to yield the right of way to Plaintiff, resulting in a substantial collision.  Plaintiff injured her knee, wrist, shoulder, and had five broken ribs.  She was taken by ambulance to the Medical Center of Central Georgia Emergency Room and later followed up with Dr. Stephen Barnes, who did arthroscopic knee surgery on her.  Plaintiff generally had a good recovery from her injuries but testified to occasional pain from her rib cage.  Dr. Barnes testified she may have future arthritic problems as a result of her injury to the knee.  Plaintiff’s case consisted of her own testimony and the testimony of her supervisor from work, her husband, and the video taped deposition of Dr. Barnes.  Defendant admitted liability at trial and presented no evidence.  The only question for the jury was how much to award Plaintiff.  The jury deliberated about ten minutes before returning its verdict.
