Plaintiff and Defendant were each traveling west on Eisenhower Parkway crossing the bridge over Interstate 75 at the intersection where there is a traffic light for the off ramp from the interstate.  The parties’ versions of the event were strikingly different.  Plaintiff testified Defendant cut into her lane of travel abruptly and caused the collision.  Defendant testified she was stopped at a red light when she was rear ended by Plaintiff.  The investigating officer testified that in his opinion the Defendant failed to yield the right of way in making a lane change.  Plaintiff was taken from the scene to the emergency room at the Medical Center by her mother.  She was then taken by her mother to the MedCenter on Riverside Drive.  She later had a follow up visit at the emergency room and then sought treatment from Dr. Ray Brant, a chiropractor, and Dr. Harvey Jones, a medical doctor.  She also had a couple of visits to a plastic surgeon about a scar on her face.  Plaintiff’s case consisted of her own testimony and the testimony of the investigating police officer, the testimony of her mother, the testimony of Defendant on cross examination, the live testimony of Dr. Jones, and the live testimony of Dr. Brant.  Defendant’s case consisted of her own testimony and the testimony of a witness who came upon the scene very shortly after the impact had occurred.  The jury deliberated about thirty minutes before returning its verdict.
