OTHER INFORMATION:
Plaintiff’s vehicle was
struck from the rear on Mercer University Boulevard near the Macon Mall at a time when traffic was very
heavy and moving slowly. Defendant
testified she rolled into the back of Plaintiff’s car, for which there was
minor property damage. Plaintiff did not
report any injury at the scene and no ambulance was called. Plaintiff drove herself to the Medical Center
of Central Georgia Emergency Room where she was treated and released. She then treated with Dr. Robert Brown, a
chiropractor, for six and one half months.
Defendant admitted negligence but disputed causation and damages.
Plaintiff had some similar injuries in the 1980’s and was in a serious car
wreck in June 2002 not long after she had her last visit with Dr. Brown. Plaintiff’s case consisted of her own
testimony and the live testimony of Dr. Brown.
Defendant’s case consisted of her own testimony as well as the testimony
of the investigating police officer. The
six person jury deliberated about 35 minutes before returning its verdict.
