Plaintiff was a passenger in a vehicle driven by Susan Briscoe when they were struck in the rear on Guy Payne Road by Defendant. Plaintiff and Ms. Briscoe had just left their place of employment at Macon Garment. They turned right on to Guy Payne Road and went a short distance before Ms. Briscoe’s car developed serious mechanical problems and came to a stop. The impact was rather substantial, and Plaintiff was taken from the scene by ambulance to the Medical Center emergency room. She later had follow up treatments with Dr. Peter Allotey. Plaintiff last treated with Dr. Allotey on July 1, 2003, and had no subsequent medical attention, although she testified to some ongoing problems. Plaintiff’s case consisted of the testimony of the investigating police officer, Ms. Briscoe, her own testimony, and the reading of 2 medical narratives, one from the emergency room doctor and one from Dr. Allotey. Defendant testified in his own behalf that he felt like there was no way he could have avoided the collision when Ms. Briscoe’s vehicle stopped suddenly and unexpectedly in the lane of travel. Plaintiff had previously settled her claim against Ms. Briscoe for $7,000 which meant she made no recovery against Defendant except for court costs.
