Defendant rear ended a car driven by Tammy Whitby which then struck Plaintiff’s car. Plaintiff had stopped for a car in front of him and Ms. Whitby had been able to stop behind him. The accident occurred on Pio Nono Avenue near the intersection with Eisenhower Parkway. There was slight damage to each of the three vehicles. No one complained of injury at the scene. Plaintiff was seen at the VA Hospital in late July and was given some over the counter medication. He went to Dr. Todd Kelleher, a chiropractor, in August and treated for a month or so. He went to Dr. Charles Foster, Jr., in December 2002 and was released in February 2003. An MRI was done but it was normal. Plaintiff has not had any medical attention since February 2003, but testified about exercises he did and restrictions on his daily routine. Plaintiff’s case consisted of the testimony of the investigating police officer, Ms. Tammy Whitby, and himself. He also presented medical narratives from the two chiropractors. Defendant testified in his own defense. The court directed a verdict against Defendant on negligence and submitted the case to the jury on causation and damages.
