OTHER INFORMATION:

Defendants admitted negligence based on failure to yield right of way at a highway intersection near Newnan, Georgia. Defendants challenged causation based on Plaintiff’s rather extensive prior history of motor vehicle collisions and injuries, his failure to go see a doctor for 5 days after the accident, and their attack on the medical evidence in the case. Plaintiff’s case consisted of his testimony and the testimony of his mother as a before and after witness. Plaintiff also presented medical narratives from a dentist who treated him for TMJ and an orthopedic surgeon. Defendants’ case consisted of the testimony of Mr. Mark Major, who was a passenger in the Defendants’ automobile, and who testified Plaintiff reported no injury at the scene. The defense also presented the deposition testimony of one of Plaintiff’s treating physicians. Plaintiff complained of injuries to his jaw, his back, and his neck. He had no surgery at any time but did see a number of doctors who did a number of different diagnostic tests.
