Plaintiff’s
vehicle was hit in the rear by Defendant’s vehicle as Plaintiff sat at a red
light on Forsyth Street at the intersection with Spring Street in Macon. Plaintiff described the impact as fairly
substantial, but she did not complain of injury at the scene, was able to drive
her own vehicle from the scene, and did not seek medical attention for eleven days. Defendant testified the impact was very
slight as a result of him falling asleep after coming to a stop behind
Plaintiff and then rolling forward.
Plaintiff sought treatment from a number of doctors but also had some
other injuries from the time of the collision until the time of trial. Defendant admitted he was negligent but
disputed causation and Plaintiff’s injuries.
In addition to past medical expenses, Plaintiff presented evidence that
she would need an anterior cervical discectomy in the future. Plaintiff’s case consisted of the cross
examination of Defendant, the reading of a deposition of Dr. Hugh McLaurin, the
playing of the videotaped depositions of Dr. James Gaudet and Dr. Norman Smith,
the reading of medical narratives from Dr. Christine Mayfield and Dr. Joe Sam
Robinson, the live testimony of Dr. Clark Stull, and her own testimony. Defendant testified in his own defense and
identified photographs of the vehicles taken after the accident. The jury deliberated about thirty minutes
before returning its verdict.
