Plaintiff, while driving a truck owned by his employer, the Macon Water Authority, collided with the rear end of a truck owned by Defendant Bates and driven by Defendant Gray. Defendant Gray was in the process of driving the truck from one driveway on the premises of Defendant Bates onto Broadway with the intention of turning back into another driveway on the premises of Defendant Bates. Plaintiff did not know what he had hit but took the position at trial that Defendant Gray failed to yield the right of way in pulling out from the Defendant Bates' property. The witnesses for the Defendants testified the road was clear when Defendant Gray pulled out and that Plaintiff came along and simply ran into the rear of the truck despite having ample time to see and avoid the truck. Plaintiff sustained substantial injuries which were not disputed at trial. Plaintiff's case consisted of his own testimony as well as the testimony of his wife, the investigating officer, a co-worker, his treating physician by way of a video taped deposition, and a medical narrative from another doctor. Defendants' case consisted of the testimony of Defendant Gray, Tommy Bates, and two other employees of Defendant Bates.
