OTHER INFORMATION:

           This case involved a childbirth in which there was a brain injury during delivery in October 1999. The child, who is now 5 years old, was allegedly injured during this forceps assisted delivery. The forceps were used in an attempt to rotate the baby. After this failed, a cesarean section was performed. The dura surrounding the brain was torn which resulted in a deviation along the suture lines of his skull. The jury deliberated 4 hours before reaching a verdict of $250,000. There was a high-low agreement of $750,000/$2,000,000 before the verdict was reached.
