Plaintiff was a passenger in Defendant Robinson's automobile when it collided with Defendant Shinholster's pick-up truck at the intersection at Rocky Creek Road and Pio Nono Avenue. Defendant Robinson contended she had a green light to proceed straight through the intersection. Defendant Chatfield contended he had a green arrow to turn left onto Pio Nono Avenue. The question for the jury as to Plaintiff's claim was whether one or both Defendants were negligent. As to the cross-claim, the jury had to consider the issue of comparative negligence. The jury ruled Defendant Shinholster was 85% at fault and Defendant Robinson was 15% at fault, meaning Defendant Shinholster did not recover on his cross-claim. The evidence at trial consisted solely of the testimony of the three parties in the case.
