Defendant's liability insurance coverage of $15,000 was paid in advance of trial. Plaintiff's uninsured motorists coverage with State Farm was for $50,000. State Farm paid $10,000 in advance of trial to avoid a bad faith claim. State Farm had also paid $765.00 in med pay coverage. Plaintiff demanded an additional $15,000 to settle the case, and State Farm had offered $5,000.

OTHER INFORMATION:

Plaintiff was southbound on Pio Nono Avenue when Defendant attempted to turn left in front of her onto Napier Avenue. Defendant contended Plaintiff's speed of 45-50 mph in a 35 mph speed zone was comparative negligence on the part of the Plaintiff. Plaintiff's case consisted of her own testimony, the testimony of her passenger, and the reading of several medical narratives. Dr. Joe Sam Robinson did back surgery on her in June, 1999. Defendant's case consisted of her own testimony, the testimony of a city traffic engineer as to the posted speed limit on Pio Nono Avenue, and the reading of numerous portions from medical records on the Plaintiff. Plaintiff had been in six or seven other motor vehicle accidents since 1990. Plaintiff also suffered other unrelated injuries in November, 1999, and did not seek any damages for medical bills or pain and suffering after that date.
