Plaintiff, a Macon Police Department bicycle patrol officer at the time, was riding his bicycle on the sidewalk in front of the Wachovia building on Mulberry Street. Defendant was coming out of the alley between the Wachovia building and the parking deck. At the time, an office equipment truck was parked in the alley where two men were in the process of unloading a copier. As Plaintiff went behind the truck to go across the alley, he was struck by Defendant. Neither the Plaintiff nor the Defendant saw the other party prior to the collision. Each contended the other was negligent. Plaintiff's case consisted of his own testimony and the video taped deposition of Dr. Frank Kelley. Defendant's case consisted of her testimony.
