Plaintiff Brock was the driver and Plaintiff Bailey was the passenger in a car which collided with Defendant's car at the intersection of Tom Hill Sr. Blvd. and the exit from the Kroger shopping center area. Defendant had the stop sign but contended Plaintiff Brock was driving too fast for conditions as she traveled in the left lane to go around slower traffic in the right lane. Neither Plaintiff sought medical attention for five days when they went to the emergency room and then three days later when they went to the Key Health Center, where they received medical attention from Dr. Jasper Hogan and Dr. Robert Lokey. They each received treatment over approximately two months and then were discharged and did not seek any additional medical treatment thereafter. The case for the Plaintiffs consisted of their testimony, the Defendant on cross examination, and the reading of two depositions taken of Dr. Lokey as to his treatment of each Plaintiff. Defendant presented no evidence.
