This accident occurred on Forest Avenue at the intersection with Neal Avenue. Plaintiff was proceeding on Forest Avenue and collided with Defendant, who had just pulled out from Neal Avenue. Plaintiff contended Defendant ran the stop sign and failed to yield the right of way. Defendant contended Plaintiff was speeding and caused the accident by coming over the hill and not being able to stop in time because of her speed. Plaintiff's case consisted of her own testimony, cross examination of Defendant, the testimony of the investigating police officer, and a medical narrative from Dr. Harvey Jones. Defendant's case consisted of the testimony of Defendant and Jim Burke, an accident reconstructionist. Plaintiff was awarded $4,220 in Magistrate Court. Defendant appealed and requested a jury trial.
