Mr. and Mrs. Ruben Williams were proceeding southbound on Hwy. 247 on their way home to a trailer park on Cargill Road. Mr. Williams slowed to make a left turn and came to a stop in the median before turning northbound on Hwy. 247, a short distance to make his turn on to Cargill Road. When Mr. Williams proceeded out into the northbound lanes to make his turn, his car was hit by Defendant, who was proceeding northbound on Hwy 247. Although Defendant had the right of way, Plaintiff contended he was driving at an excessive rate of speed and in a reckless manner. Another northbound motorist testified at trial that he witnessed Defendant's speed and weaving in and out of lanes several miles before the accident occurred. Plaintiff, who was the appointed administrator of her father's estate after he died in 2002 for causes unrelated to the accident, presented the testimony of her mother, herself, her father's deposition testimony, the investigating sheriff's deputy, the video taped deposition of the other motorist, her husband, who had taken some photographs of Mr. Williams and the scene, and the medical narrative of Dr. Waldo Floyd. Defendant, who was called for cross examination during the Plaintiff's case, presented no evidence on his own behalf.
