Plaintiffs were rear ended in the parking lot at a grocery store. The other driver left the scene. Allstate chose to defend this uninsured motorist's claim in its own name. The Plaintiffs' vehicle had minimal damage. Both Plaintiffs told the police officer they were not hurt, but sought medical attention at MedCenter West the next day and then started treating with Dr. David Reise about three weeks later. They each treated with Dr. Reise for about eight weeks. They each had been in a previous motor vehicle accident in March, 1997, and treated with Dr. Reise through June, 1997. The injuries from the two events were very similar. Plaintiffs' case consisted of their own testimony, the live testimony of Dr. Reise, and the police officer. The defense questioned whether the collision even took place in addition to challenging Plaintiffs on whether this event could have caused their alleged injuries.
