Plaintiff's vehicle was struck on Northside Drive by Defendant's vehicle as Defendant came around a curve and crossed the center line. Both cars had to be removed from the scene by wreckers. Plaintiff did not report any injury to the investigating officer and did not need an ambulance. She sought treatment from her family doctor who referred her to Dr. Hugh Smisson III. She saw Dr. Thomas Ferrari two and one-half years after the accident, and he diagnosed her with fibromyalgia. Plaintiff had been treated before this accident for symptoms very similar to what she later reported as to this case. Her husband was seeking damages for loss of consortium. She and her husband owned and operated a landscape service. Plaintiff's case at trial consisted of the testimony of her and her husband, the investigating officer, Dr. Ferrari by deposition, and medical narratives from Dr. Smisson. Defendant did not testify.
